By entering the “[Tomasky Twitter Book Giveaway]” (the “Sweepstakes”), you agree to comply with and be bound by the following official Sweepstakes rules. If you do not agree with the rules in their entirety, you are not permitted to enter the Sweepstakes.
Eligibility: Sweepstakes is open only to legal residents of the fifty United States and the District of Columbia who are 21 years of age or older at time of entry. Sweepstakes is void where prohibited and is subject to all applicable federal, state and local laws. This sweepstakes is sponsored by The Daily Beast Company LLC, 555 W. 18th St., NY, NY 10011 (“Sponsor”). Employees of the Sponsor and its parent company, affiliates, subsidiaries, divisions, advertising and promotion agencies, and immediate family members (defined as spouse, siblings, parents and children) and/or those living in the same household (whether related or not) of each are not eligible to enter the Sweepstakes.
How to Enter: To enter, follow @thedailybeast on Twitter and send an @ message to @thedailybeast with the information as directed in Sponsor’s tweet. Sweepstakes ends on 2/7/14 at 6:00PM EST. Only one entry per person. Any person found to use multiple Twitter usernames or multiple Twitter updates to enter will be ineligible. Alternatively, entrants may email their full name, email address and postal address to [editorial@thedailybeast.com]. Emailed entries must be received by close of sweepstakes. Entries are subject to all notices posted online including but not limited to privacy policies of Sponsor.
All entries become the property of Sponsor, and Sponsor reserves the right to use any information submitted by entrants as permitted by its privacy policies. Sponsor is not responsible for lost, late, illegible, misdirected or mutilated entries, including due to transmission, technical, and/or network failures of any kind, including, without limitation, malfunctioning of any hardware or software (whether originating with sender or Sponsor), Internet or email failures, human error, or any other error or malfunction of Twitter.
If there is a dispute as to the identity of an entrant, entry will be declared made by the authorized account holder of the Twitter username associated with the entry. An “authorized account holder” shall mean the natural person assigned to such account by Twitter. A potential winner (“Winner”) may be requested to provide proof that he or she is the authorized account holder of the Twitter username associated with a winning entry.
Entrants agree not to upload, post, email or transmit any materials which contain any computer viruses, worms, Trojan Horses or other harmful component or programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information. Any attempt to deliberately damage any web site or undermine the operation of the promotion is a violation of criminal and civil laws, and Sponsor reserves the right to seek damages from any person who makes such attempt(s).
Prize and Approximate Retail Value: One prize (the “Prize”), consisting of one copy of the e-book [Yeah! Yeah! Yeah!: The Beatles and America, Then and Now [Kindle Edition]] by [Michael Tomasky], will be awarded (approximate retail value: $5.49 USD). Odds of winning depend upon the number of eligible entries received. Winner will be selected by random drawing on 2/3/14, 2/4/14, 2/5/14, 2/6/14, 2/7/14 from all eligible entries received during each day’s Entry Period. Winner will be solely responsible for any and all local, state, and federal taxes and fees. The Prize may not be exchanged or redeemed for cash or any other consideration, sold or traded. No prize transfer, assignment, or substitution by Winner is permitted. The Prize will not be replaced if lost, mutilated, or stolen. Sponsor reserves the right to substitute a prize, in which case a prize of equal or greater value will be awarded. Winner is responsible for any and all other costs and expenses not mentioned in the Prize description.
Winner will be notified by Twitter message or email. In the event that the prize notification or the Prize is returned as undeliverable, or if any attempted notification is not successful within one (1) day (including if the winner fails to respond within 1 day of notification) the Prize will be forfeited and Sponsor reserves the right to randomly select an alternate winner from among the remaining eligible entries.
CONDITIONS AND RESTRICTIONS APPLY:
By participating in the Sweepstakes, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of the Sponsor, which are final and binding in all matters relating to the Sweepstakes. The Sponsor reserves the right to: (i) permanently disqualify from the Sweepstakes any person it believes has intentionally violated these Official Rules; and (ii) cancel, suspend and/or modify the Sweepstakes without any liability if any fraud, virus or other factor beyond Sponsor’s reasonable control impairs the administration, functioning or proper play of the Sweepstakes, as determined by Sponsor in its sole discretion, and withdraw any method of entry if it becomes technically corrupted and to select winner from among all eligible entries received prior to withdrawal. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances.
Winner must fully and unconditionally comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. A driver’s license or other form of government issued identification may be required to claim the Prize. Winner is subject to verification by Sponsor, whose decisions are final and binding in all matters related to the sweepstakes. An entrant is not a winner of any prize unless and until entrant’s eligibility has been verified and entrant has been notified that verification is complete. In the event that a winner is determined to be ineligible, the prize will be forfeited and Sponsor reserves the right to randomly select an alternate winner from among the remaining eligible entries. Sponsor reserves the right to terminate the Sweepstakes without awarding the Prize if no eligible winner or alternate winner claims the prize within the required time period.
Winner may be required to execute a release and affidavit of eligibility (except where prohibited) within fourteen (14) days of notice of winning. If Winner fails to execute and return a release and affidavit of eligibility (except where prohibited) within fourteen (14) days of notice of winning, the Prize may be forfeited and an alternate winner may be chosen from among the remaining eligible entries.
Winner agrees to the use of his/her name and likeness in publicity without any additional compensation (except where prohibited). By entering this sweepstakes, Winner acknowledges that Sponsor has the right to publicize, broadcast, display and/or otherwise use in any medium, Winner’s name, Twitter handle, image, and likeness, the fact that Winner won, and all matters incidental thereto.
LIMITATION ON LIABILITY: By entering this sweepstakes, each entrant forever discharges, releases, and holds harmless Sponsor and its parent company, subsidiaries, affiliates, and each of their respective directors, officers, employees, and agents from any and all liability, claims, losses, damages, causes of action, suits, and demands of any kind arising from or in connection with the Sweepstakes, including, without limitation, responsibility for property damage, loss of life, or personal injury resulting from or in connection with participating in the Sweepstakes or from or in connection with use or receipt of the Prize, however caused.
Sponsor has not made nor is in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, with respect to the Prize, including, without limitation, to the Prize’s quality or fitness for a particular purpose. Sponsor is not responsible for any typographical or other error in the advertising for the Sweepstakes, administration of the Sweepstakes or in the announcement of the Prize, and is not responsible if Sweepstakes cannot take place or if the Prize cannot be awarded due to events beyond its control, including as a result of delays or interruptions due to acts of God, acts of war (declared or undeclared), natural disasters, weather, acts of terrorism, riot or civil disturbance, satellite or equipment failure, federal state or local government law, order or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within Sponsors’ control (each a “Force Majeure” event or occurrence).
SPONSOR’S RESERVATION OF RIGHTS: These Official Rules are subject to modification by Sponsor. In the event of a dispute, all decisions made by Sponsor are final and binding. Sponsor reserves the right, in its sole discretion, to disqualify any person who tampers with or abuses the entry process, or who otherwise acts in violation of these Official Rules. Sponsor further reserves the right, in its sole discretion, to cancel, terminate, or modify this sweepstakes if, for any reason, including if in Sponsor’s sole discretion the sweepstakes is not capable of completion as planned, including due to a Force Majeure or non-authorized human intervention that compromises or affects the administration, fairness, integrity, or proper conduct of the Sweepstakes.
APPLICABLE LAWS AND JURISDICTION: This Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by and interpreted under the laws of the State of New York without regard to its conflicts of laws provisions. By participating, entrants agree that any and all disputes arising out of or relating in any way to this Sweepstakes shall be resolved individually, and without resort to class action, exclusively by a state or federal court located in New York, New York. Should there be a conflict between the laws of the State of New York and any other laws, the conflict will be resolved in favor of the laws of the State of New York. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. All judgments or awards shall be limited to actual out-of-pocket damages (excluding attorneys’ fees) associated with participation in this Sweepstakes and shall not include any indirect, punitive, incidental and/or consequential damages.
