Just hours after it granted a temporary stay of execution, the Supreme Court rescinded the last-minute request to halt the execution of Herbert Smulls. Convicted of murdering a jeweler, Smulls faces the death sentence, but his lawyers challenged the execution, citing among other issues that the state refused to disclose where it had obtained the lethal injection. The Supreme Court had granted a stay three hours prior to the execution scheduled for 12:01 a.m. Wednesday, but vacated the stay without explanation Wednesday afternoon.
